Please read this agreement carefully before purchasing a ticket or attending Tents & Tunes.

By accepting this agreement, you acknowledge that Tents & Tunes is an outdoor music and camping event involving inherent and other risks, including risks that may result in property damage, illness, serious bodily injury, permanent disability, or death.

1. Event and Parties

This Assumption of Risk, Release of Liability & Event Participation Agreement ("Agreement") applies to attendance at and participation in Tents & Tunes, taking place September 10–13, 2026 at Camp Manitowa in Illinois ("Event").

For purposes of this Agreement, the "Released Parties" include:

DARRELL SMITH and ALICIA COLE, doing business as Tents & Tunes; Camp Manitowa and its respective owners, operators, property owners, officers, directors, members, managers, employees, agents, representatives, volunteers, contractors, and affiliates; and, to the extent applicable, all Tents & Tunes organizers, promoters, sponsors, vendors, performers, contractors, employees, representatives, agents, volunteers, affiliates, successors, and assigns.

2. Acknowledgment of Event Risks

I understand that Tents & Tunes is an outdoor, overnight music and camping event and that attendance and participation involve risks that cannot be completely eliminated.

These risks include, but are not limited to, risks associated with:

• camping and sleeping in cabins, yurts, tents, recreational vehicles, and other accommodations;
• walking or moving over uneven, wet, muddy, rocky, wooded, or slippery terrain;
• stairs, pathways, roads, parking areas, docks, waterfront areas, and other structures;
• darkness and limited nighttime visibility;
• rain, storms, lightning, wind, heat, cold, humidity, and other changing weather conditions;
• lakes, beaches, docks, swimming, canoeing, kayaking, paddleboarding, and other water or waterfront activities;
• drowning, slipping, falling, collisions, and water-related injuries;
• campfires, grills, cooking equipment, flames, hot surfaces, smoke, and other fire-related hazards;
• insects, ticks, mosquitoes, plants, wildlife, and other natural conditions;
• automobiles, golf carts, recreational vehicles, trailers, service vehicles, and other transportation;
• dancing, crowds, amplified music, stages, sound equipment, electrical equipment, temporary structures, and Event equipment;
• food, beverages, food allergies, and food preparation;
• the possession or consumption of alcoholic beverages by attendees;
• dehydration, fatigue, physical exertion, and existing health conditions;
• recreational activities and facilities available at or near the Event;
• lost, stolen, or damaged personal property;
• acts or omissions of other attendees, guests, performers, vendors, contractors, or other third parties;
• limited or delayed access to emergency medical treatment due to the outdoor or remote nature of the Event; and
• other risks ordinarily associated with outdoor festivals, camping, music events, recreational activities, and overnight stays.

I understand that this list cannot identify every possible risk or circumstance that may arise during the Event.

3. Voluntary Assumption of Risk

I knowingly and voluntarily choose to attend and/or participate in Tents & Tunes.

I understand and accept that doing so may expose me to risks of property damage or loss, illness, bodily injury, permanent disability, or death.

I knowingly and voluntarily assume the risks associated with my attendance at and participation in the Event, including both known and reasonably foreseeable risks associated with the activities, conditions, facilities, property, and environment described in this Agreement.

4. Release of Liability

TO THE FULLEST EXTENT PERMITTED BY ILLINOIS LAW, I RELEASE AND DISCHARGE THE RELEASED PARTIES FROM CLAIMS FOR PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO MY ATTENDANCE AT OR PARTICIPATION IN TENTS & TUNES, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.

I understand that by accepting this Agreement I am giving up certain legal rights that I might otherwise have with respect to risks and claims covered by this Agreement.

This release is intended to apply only to the fullest extent permitted by applicable law.

Nothing in this Agreement is intended to release liability that cannot legally be released or waived under Illinois law, including liability for willful and wanton or intentional misconduct where such liability cannot legally be waived.

5. Water and Recreational Activities

I understand that swimming, canoeing, kayaking, paddleboarding, waterfront activities, and other recreational activities may involve additional risks, including falls, collisions, drowning, serious injury, and death.

I understand that participation in any such activity is voluntary.

I agree not to participate in an activity that I believe exceeds my physical abilities, swimming abilities, experience, or comfort level, and I agree to obey all posted rules and instructions relating to recreational activities.

Life jackets are required at all times while participating in water activities where required by Event or Camp Manitowa rules, including applicable canoeing, kayaking and paddleboarding activities. I agree to comply with all posted water-safety requirements and instructions from Event and venue staff.

6. Alcohol and Personal Conduct

I understand that I am responsible for my own decisions and conduct during the Event.

If I choose to consume alcohol, I accept responsibility for doing so responsibly and for any consequences resulting from my own consumption.

I agree not to operate a vehicle, participate in water activities, use equipment, or engage in any activity when doing so would be unsafe because of alcohol consumption, impairment, fatigue, medical condition, or any other reason.

I understand that Tents & Tunes may remove an attendee from an activity or from the Event for unsafe, disruptive, unlawful, or inappropriate conduct in accordance with Event policies.

7. Personal Property

I understand that I am responsible for securing and protecting my own personal property.

To the fullest extent permitted by law, I assume the risk of loss, theft, or damage to personal belongings brought to the Event.

8. Health and Medical Responsibility

I am responsible for determining whether I am physically able to participate safely in the Event and any activities I voluntarily choose to participate in.

I understand that immediate medical care may not always be available and that emergency response times may be affected by the location or conditions of the Event.

If an emergency occurs and I am unable to provide consent, I authorize Event or venue personnel to seek reasonable emergency medical assistance on my behalf.

I understand that I remain responsible for medical, ambulance, transportation, hospital, or other expenses incurred on my behalf.

9. Responsibility to Follow Event Rules

I agree to follow all Event, campground, venue, safety, recreational, fire, waterfront, and alcohol-related rules and instructions.

I agree to use reasonable care for my own safety and the safety of others.

If I believe a condition or activity is unsafe, I agree to avoid the condition or stop participating and notify Event or venue personnel when appropriate.

10. Tickets Purchased on or After August 6, 2026

For tickets purchased on or after August 6, 2026, acceptance of this Agreement is required as part of the ticket-purchase and/or attendee-registration process.

Checking the acceptance box or electronically submitting this Agreement constitutes my acknowledgment that I have been provided an opportunity to read this Agreement and that I voluntarily agree to its terms.

11. Tickets Purchased Before August 6, 2026

If my ticket was purchased before August 6, 2026, I understand that my original ticket purchase alone did not constitute acceptance of this Agreement.

I am being separately provided this Agreement so that I may review and affirmatively accept it before attending Tents & Tunes.

By electronically signing, checking the acceptance box, or otherwise submitting my acceptance of this Agreement after my original ticket purchase, I acknowledge that I have read and understand this Agreement and voluntarily agree to its terms before attending or participating in the Event.

12. Each Attendee Must Accept

Purchase of multiple tickets by one person does not constitute acceptance of this Agreement on behalf of every person using those tickets.

Each individual attendee must review and accept this Agreement before admission to the Event.

The purchaser is responsible for informing additional members of their party that individual acceptance may be required before Event admission.

13. No Representation That the Event Is Risk-Free

I understand that reasonable efforts may be made to promote safety but that no outdoor event, campground, recreational facility, concert, or gathering can be made completely free of risk.

The existence of Event rules, staff, security personnel, emergency procedures, recreational equipment, signs, or other precautions does not constitute a representation or guarantee that injury, illness, loss, or other harm cannot occur.

14. Severability

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall continue in effect to the fullest extent permitted by law.

15. Governing Law

This Agreement shall be interpreted under the laws of the State of Illinois.

16. Acknowledgment and Acceptance

I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS ASSUMPTION OF RISK, RELEASE OF LIABILITY & EVENT PARTICIPATION AGREEMENT.

I UNDERSTAND THAT IT INCLUDES AN ASSUMPTION OF RISK AND A RELEASE OF CERTAIN CLAIMS, INCLUDING CERTAIN CLAIMS ARISING FROM ORDINARY NEGLIGENCE.

I UNDERSTAND THE RISKS ASSOCIATED WITH ATTENDING AN OUTDOOR MUSIC AND CAMPING EVENT AND VOLUNTARILY AGREE TO THESE TERMS.

I CERTIFY THAT I AM AT LEAST 25 YEARS OLD.
